In 2020, California adopted a number of new criminal laws and… In 2020, California adopted a number of new criminal laws and procedures.  One of the most fundamental changes was made to the probationary periods applicable to most misdemeanors and felonies.  In the past, most misdemeanors carried a probationary period of 3 years.  Felonies carried a 5 year period.  This means that if a defendant was granted probation, there would be some sort of either formal or informal supervision of that defendant for 3 years or 5 years from the date of conviction or plea of guilty to a charge.  This has been the law for decades.Now, the probationary periods have been reduced for all but the most serious of offense.  For most misdemeanors the maximum probation time is 1 year and for felonies, it is 2 years.  This means that, for example, assault with a deadly weapon has a 2 year max probation, instead of five.  A felon in possession of a firearm – also 2 years.  Criminal threats – 2 years.  The longer periods for probation are reserved for sex offenses, domestic violence and violent strikes (although both Criminal threats and Assault with a deadly weapon are strike offenses).  These changes also apply retroactively. Question : Is it a positive reform to the criminal justice system or a negative one?  What are the pros and cons of this change?   Law Social Science Criminal Justice CJ 205
